E-Verify/Basic Pilot Employment Eligibility |

As we have reported in the past, regulations implementing a modified version of the E-Verify/Basic Pilot employment eligibility program have been suspended due to pending litigation by the business community. The suspension was expected to last until June 30, 2009. Yesterday, litigants agreed to extend this deadline until September 8, 2009, and they also asked the court to stay further proceedings in order to allow the Obama Administration further time to review the proposal. A notice of this new date is expected to appear next week in the Federal Register. Specific issues which litigants continue to debate include requirements to re-verify existing workers and vicarious liability for subcontractors.
